there was a case like that not too long ago someplace like Michigan. Same consivitive judges ruling. If I recall, the difference was that the boy was not a minor and the girl was a couple months away from not being a minor. The boy ended up with jail time for CP.

Quote:

Judge James Wolf, a former prosecutor, wrote the majority opinion.
Wolf speculated that Amber and Jeremy could have ended up selling the photos to child pornographers ("one motive for revealing the photos is profit") or showing the images to their friends. He claimed that Amber had neither the "foresight or maturity" to make a reasonable estimation of the risks on her own. And he said that transferring the images from a digital camera to a PC created innumerable problems: "The two computers (can) be hacked."
how friggen stupid is that... If there was a gun in the room, they should also be booked for murder as they 'could' have used it to kill somebody. Don't these people have real criminals to go after?!

Yeah some laws make you go Hmmm.. I'm not condoning spam and I know it's horrible that kids/adults get adult material via unsolicited email but why is it you spend more time in a fed pen for sending emails than you would for killing someone drinking and driving?

it's all part of the 'send an email, go to jail' campaign, which piggy backs on the 'words is bad' campaign. Soon, the majority of electronic communications will be illegal... :geez:
